Some of these practices include: reverse payments, citizen petitions, product hopping, and the misclassification of drugs. This Note argues that pharmaceutical companies have engaged in some of these practices and that the Hatch-Waxman Act must be amended to prevent these companies from continuing to circumvent the true intention of the Act.

The main radical change should concern the present management of pharmaceutical patents by introducing a specific agency dedicated to them. Secondly, specific pharmaceutical patents could be restricted to compounds for one (or more) declared indication(s). Thirdly, pharmaceutical patents should be kept only for compounds that start a first clinical trial within five years from the granting date.

Os resultados mostraram que a maior parte das empresas de biotecnologia está concentrada nos Estados de São Paulo e Minas Gerais e são, em sua grande maioria, jovens empresas. Dentre as principais dificuldades encontradas por estas empresas está a obtenção de máquinas e mão de obra qualificada. Além disso, observou que ainda não há uma relação de troca de informações estruturada que facilite a inovação tecnológica entre essas empresas. Entretanto, este cenário está mudando e as empresas já estão sentindo a necessidade e a importância de um formato organizacional mais inter-relacionado com as universidades, empresas, setor financeiro e governo.

Product approvals for neglected diseases have increased, though progress has been uneven, with malaria appearing to benefit most in the short run from increased funding, while less success has been booked in other disease categories. Uneven progress suggests funding could be better targeted, particularly with regard to neglected diseases that have hitherto received scant attention.
